The terms that apply when using our website and placing an order with Smash Guys.

1. About these terms

These Terms & Conditions apply when you use the Smash Guys Kebab & Pizza website and place an order through our online ordering service.

By placing an order through our website, you confirm that you have read and accepted these Terms & Conditions.

2. Ordering from us

You can place an order through our website by selecting the items you wish to purchase, providing the requested information and completing the checkout process.

Please check your order carefully before submitting it. You are responsible for ensuring that the information you provide, including your delivery address and contact details, is accurate.

An order is subject to acceptance and availability. We may be unable to accept an order where an item is unavailable, there is a technical problem, payment cannot be authorised, or we reasonably believe the order cannot be fulfilled.

3. Prices and menu availability

Prices shown on our website are the prices applicable at the time you place your order, subject to any clearly stated delivery charges or other applicable charges.

We may change menu items, prices, descriptions or availability from time to time.

We make reasonable efforts to ensure that menu information is accurate, but availability can change and an item may occasionally become unavailable after an order is placed.

4. Payment

Payment must be completed using the payment methods made available during checkout.

Online payments may be processed by third-party payment providers, including myPOS. Your payment may therefore be subject to the payment provider's own terms and policies.

If payment is declined, reversed or otherwise unsuccessful, we may be unable to fulfil the order until payment has been successfully completed.

5. Delivery

We aim to deliver orders within an estimated timeframe of 45 to 60 minutes from order confirmation for local delivery to the cardholder.

Delivery times are estimates and may be affected by traffic, severe weather, peak ordering hours, or circumstances outside our reasonable control. In peak periods, the maximum delivery timeframe will not exceed 90 minutes.

Please provide an accurate delivery address and a telephone number through which we can contact you if necessary.

If we are unable to complete delivery because incorrect or insufficient delivery information was provided, we may not be able to provide a refund for food that has already been prepared.

6. Collection orders

If you choose collection, your order will be prepared for collection from our premises at:

Please collect your order within a reasonable period after being notified that it is ready.

7. Cancelling an order

Because our food is prepared fresh to order and is perishable, you must contact us as soon as possible if you wish to cancel your order.

Cancellation Policy & Timeframe

  • •Before Kitchen Preparation: Orders can be cancelled for a full refund if you contact us immediately before preparation has started.
  • •After Kitchen Preparation: Once kitchen preparation has commenced, orders cannot be cancelled or refunded due to the perishable nature of prepared food.

8. Refunds and problems with an order

We take great pride in our food quality and service. If there is a problem with your order, please review our refund policies below:

1. Eligibility Conditions for a Refund

Customers are eligible for a partial or full refund under the following circumstances:

  • An item is missing, incorrect, or substantially damaged upon receipt.
  • An order was cancelled before food preparation commenced.
  • The order was not delivered due to an error on our part.

2. Timeframe for Requesting a Refund

Due to the perishable nature of hot food, any issue or refund request must be reported to us within 1 to 2 hours of receiving your order (or within 2 hours of the estimated delivery time if the order failed to arrive). Please call us on 01282 220286 with your order reference.

3. Expected Processing Timeframe & Refund Method

Once a refund request is approved, the refund will be processed back to the customer's original payment method (card payment processed via myPOS). Approved card refunds typically take 3 to 5 business days to process and credit to your account, depending on your card issuer.

Nothing in these Terms & Conditions is intended to remove or restrict any consumer rights that cannot legally be excluded under UK consumer protection law.

9. Allergens and ingredients

Please inform us of any allergies or dietary requirements before ordering and review the allergen information provided with our menu.

Although we take reasonable steps to manage allergens, our kitchen handles a range of ingredients and we cannot guarantee that any food is completely free from traces of allergens.

If you have a serious food allergy, please contact us before ordering so that we can discuss your requirements.

10. Customer responsibilities

When using our website, you agree that you will:

  • Provide accurate and complete information when ordering
  • Use the website only for lawful purposes
  • Not attempt to interfere with or compromise the website or ordering system
  • Not use another person's payment method or personal information without permission
  • Keep any account credentials secure where an account is provided

11. Website availability

We aim to keep our website and online ordering service available, but we do not guarantee uninterrupted or error-free availability. We may temporarily suspend or modify the website for maintenance, security, technical or operational reasons.

12. Events outside our control

We will not be responsible for delays or failures caused by events that are outside our reasonable control, including severe weather, traffic disruption, power or internet failures, supplier problems, industrial action or other circumstances that materially affect our ability to operate.

13. Our liability

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful. This includes liability that cannot legally be excluded under applicable consumer or food safety law.

14. Changes to these terms

We may update these Terms & Conditions from time to time. The latest version will be displayed on this page. Changes will not retrospectively alter the terms applying to an order that has already been accepted, except where required by law.

15. Governing law

These Terms & Conditions are governed by the laws applicable in England and Wales. Any dispute will be subject to the jurisdiction of the courts applicable under those laws, subject to any mandatory consumer rights you may have.
